Toxic oceans may have delayed spread of complex life

Feb. 28, 2013 ? A new model suggests that inhospitable hydrodgen-sulphide rich waters could have delayed the spread of complex life forms in ancient oceans. The research, published online this week in the journal Nature Communications, considers the composition of the oceans 550-700 million years ago and shows that oxygen-poor toxic conditions, which may have delayed the establishment of complex life, were controlled by the biological availability of nitrogen.

In contrast to modern oceans, data from ancient rocks indicates that the deep oceans of the early Earth contained little oxygen, and flipped between an iron-rich state and a toxic hydrogen-sulphide-rich state. The latter toxic sulphidic state is caused by bacteria that survive in low oxygen and low nitrate conditions. The study shows how bacteria using nitrate in their metabolism would have displaced the less energetically efficient bacteria that produce sulphide -- meaning that the presence of nitrate in the oceans prevented build-up of the toxic sulphidic state.

The model, developed by researchers at the University of Exeter in collaboration with Plymouth Marine Laboratory, University of Leeds, UCL (University College London) and the University of Southern Denmark, reveals the sensitivity of the early oceans to the global nitrogen cycle. It shows how the availability of nitrate, and feedbacks within the global nitrogen cycle, would have controlled the shifting of the oceans between the two oxygen-free states -- potentially restricting the spread of early complex life.

Dr Richard Boyle from the University of Exeter said: "Data from the modern ocean suggests that even in an oxygen-poor ocean, this apparent global-scale interchange between sulphidic and non-sulphidic conditions is difficult to achieve. We've shown here how feedbacks arising from the fact that life uses nitrate as both a nutrient, and in respiration, controlled the interchange between two ocean states. For as long as sulphidic conditions remained frequent, Earth's oceans were inhospitable towards complex life."

Today, an abundance of nitrate, in the context of an oxygenated ocean, prevents a reversion to the inhospitable environment that inhibited early life. Determining how Earth's oceans have established long-term stability helps us to understand how modern oceans interact with life and also sheds light on the sensitivity of oceans to changes in composition.

PM Note: Washington Split Screen With Rosa Parks, Voting Rights, An Interview With Eric Holder, 'Spare Me' Sequestration

Washington Split Screen - Rosa Parks at the Capitol, Voting Rights Act at the Court - It was a strange day of confluences in Washington and on the two sides of 1st St., N.E.

While conservatives on the Supreme Court expressed deep skepticism about a key provision of the Voting Rights Act, suggesting it was no longer necessary? literally across the street at just about exactly the same time the President and Congressional leaders were unveiling a statue to honor Rosa Parks, an icon of the civil rights movement.

"She defied the odds. she defied injustice," said President Obama of Parks. House Speaker John Boehner shed a tear. http://abcn.ws/YFetkA

With Parks' victory in the bus boycott, said Obama, "?the entire edifice of segregation, like the ancient walls of Jericho, began to slowly come tumbling down."

Across the street, they weren't memorializing a hero, but discussing the future of a 48-year-old law. Supreme Court Justice Antonin Scalia was talking about the continued Constitutionality of the Voting Rights Act, a landmark piece of legislation first passed about a decade after Parks refused to stand up.

Scalia was talking about the unanimous vote to reauthorize the Voting Rights Act in 2006.

"I think it is attributable, very likely attributable, to a phenomenon that is called perpetuation of racial entitlement. It's been written about. Whenever a society adopts racial entitlements, it is very difficult to get out of them through the normal political processes.

"And I am fairly confident it will be re-enacted in perpetuity unless a court can say it does not comport with the Constitution," he continued. "You have to show, when you are treating different states differently, that there's a good reason for it. "

Scalia said, "That's the concern that those of us who have some questions about this statute have. It's a concern that this is not the kind of a question you can leave to Congress."

If their questioning is any indication, conservatives like Scalia on the court seem poised to overturn a key part of the law, which requires states to pre-clear newly drawn legislative boundaries with the Justice Department - More from Ariane de Vogue - http://abcn.ws/VaY3Av

ZTE Grand Memo hands-on

ZTE Grand Memo.

ZTE, like local rival Huawei, is desperately trying to establish itself as one of the bigger international smartphone players, focusing more and more on high-end "hero" devices. To that end, at a very businesslike (and rather awkward) Mobile World Congress press conference this week, the company revealed the Grand Memo. A 5.7-inch Galaxy Note-class device, the Memo incorporates high-end internals and a massive 5.7-inch 1080p display.

Officially, the Grand Memo runs Qualcomm's quad-core Snapdragon 800 CPU, though ZTE itself says the chipsets used will vary depending on country. For what it's worth, the company also had an NVIDIA Tegra 3-based Grand Memo on show at its MWC booth, however that device was unstable and extremely hot to the touch.

Other hardware notables include 2GB of RAM, 16GB of storage, 4G LTE support and a 13MP rear camera. The physical hardware of the Memo is standard smartphone fare -- a black slab with a plastic back and three buttons down below. On the back, a plastic battery cover. We saw several different back covers on the Grand Memo demo units at the show -- glossy, textures and matte versions in white and various shades of blue. Overall, the hardware is perfectly serviceable, if not outstanding.

QQA statement on Cantrell tear-downs

Posted by Leslie Newell Peacock on Tue, Feb 26, 2013 at 1:00 PM

The Quapaw Quarter Association has issued a press release on its unsuccessful efforts to stave off the demolition of the Bruner House at 1415 Cantrell Road and the house next door, at 1407 Cantrell, including two letters it wrote the Episcopal Collegiate School and Stephens Inc.

We reported here yesterday that mantels and other architectural components of the house are being salvaged by an Alabama company, Southern Accents.

The letters note that the houses are not in a historic district and could only be protected by the conservation efforts of their owners, and says their destruction should prompt debate about the loss of Little Rock's historic buildings. The 2009 demolition of buildings on the west side of the 400 block of Main Street, including the old Kempner building and the Center Theater ? also by Stephens ? prompted a preservation plan for the city, useless without the creation of historic districts.

The QQA release:

You may be aware that 1407 and 1415 Cantrell Road are slated for demolition soon. It is with deep regret that we watch these houses come down; they are structurally sound and would be appropriate for many uses.

In April of 2011 when the QQA learned that these and one other house had changed hands, we reached out to the new owners in a number of ways and offered to help find new uses. We also provided several examples of historic houses that have been incorporated into learning institution campuses.

View the QQA's letter to the Episcopal Collegiate School

View the QQA's letter to Stephens, Inc.

Because the houses are not in a protected district, few options were available to us beyond persuading the new owners of the value and potential of the houses. Unfortunately, we received little response to our recommendations and offers of assistance.

The Bruner-Hammond House at 1415 Cantrell Road is individually listed in the National Register of Historic Places. However, this is an honorary designation that does not protect the house from demolition. In Little Rock, the only historic buildings protected from demolition are within the MacArthur Park Historic District and the Capitol Zoning District. Many property owners in other parts of town take advantage of incentives and see historic preservation as a smart investment, but they are not required to do so.

We hope the unfortunate loss of these historic houses will spur new dialogue about how we, as a community, can encourage smarter development practices and prevent further loss of our historic fabric. We can do this by creating more local historic districts and implementing better preservation policy at the city level. We welcome your ideas and involvement.

Tenet swings to profit as hospital visits rise

(Reuters) - Tenet Healthcare Corp on Tuesday reported a fourth-quarter profit versus a year-ago loss as outpatient hospital visits increased and said it sees health reform next year will have a positive impact on earnings.

An estimated 26 million people, many of them now uninsured, are expected to obtain coverage through health insurance exchanges being set up under the U.S. Patient Protection and Affordable Care Act.

Tenet, the No. 3 for-profit U.S. hospital chain, said it has traditionally served a larger number of uninsured patients than other publicly traded chains. This burden is expected to diminish as those patients are insured through the exchanges, beginning in 2014.

"We see a lot of upside in our markets," Tenet Chief Executive Trevor Fetter said on a conference call.

Fetter said Tenet recently signed its first contracts with three Blue Cross and Blue Shield plans for health insurance to be sold through the exchanges, covering about 30 percent of its hospitals. The plans have a similar structure as its commercial contracts, with a pricing discount of less than 10 percent from current rates.

"Where we have accepted any discount at all, it is for additional market share," Fetter said.

Tenet posted fourth-quarter earnings of $49 million, or 45 cents a share, compared with a loss of $76 million, or 70 cents a share, a year earlier, when the company took a large charge for the early retirement of debt.

Adjusted earnings before interest, taxes, depreciation and amortization (EBITDA) increased 16.7 percent to $336 million. Net operating revenue rose 7.3 percent to $2.33 billion.

Tenet reiterated its outlook for 2013 EBITDA of $1.325 billion to $1.425 billion.

In the fourth quarter, Dallas-based Tenet said adjusted patient admissions rose 2.9 percent, with outpatient visits up 7.3 percent and outpatient surgeries climbing 13.9 percent. Total admissions were flat, while emergency room visits increased 8.6 percent.

Uninsured and charity admissions rose 1.1 percent. Bad debt expenses as a percentage of revenue was 7.9 percent, up from 7.7 percent from a year ago, as more uninsured patients sought treatment, Tenet said.

Tenet shares were down 1.4 percent at $37.12 on the New York Stock Exchange.

doubleTwist and Qualcomm to launch MagicPlay, an open-source ...

qualcomm_rf360_global_LTE_solution

Qualcomm has teamed up with the developers of doubleTwist?to create an open sourced media streamer for all Android devices called MagicPlay. Well, all devices with a Qualcomm chip with their AllJoyn protocol, that is. That AllJoyn protocol will allow a device to stream media to any other device, and it?s being positioned as a competitor to Apple?s AirPlay.

MagicPlay will let users wirelessly stream media through WiFi, completely skipping Bluetooth connectivity. It?s also to bet set up so manufacturers can add a single component to devices to allow streaming, and developers can freely embed MagicPlay streaming in their applications. Hopefully we?ll see this take off as well as Qualcomm?s Snapdragon chips have done in the past few years. Hit the break for the press release, and be sure to check out the rest of our MWC coverage here.

doubleTwist? Announces MagicPlay?

Today at Mobile World Congress, doubleTwist announced a partnership with global chip maker Qualcomm to bring a new open source wireless media streaming platform to the marketplace.

The two companies will demonstrate the new technology to representatives from the mobile, wireless and consumer electronics industries at this week?s premier global mobile conference. Built upon Qualcomm?s AllJoyn platform, doubleTwist?s MagicPlay will effortlessly connect smartphones and tablets with speakers, TVs, car audio systems and more.

?Over the last year we have been asked by many device makers if we could develop a simple and universal solution for the consumer electronics market that would serve the hundreds of millions of Android and other devices outside the Apple ecosystem,? said Jon Lech Johansen, of doubleTwist. ?MagicPlay enables users to amplify their smartphone?s music and enjoy it on any speaker or entertainment system. Our partnership with Qualcomm will enable OEMs to easily integrate this functionality with devices they bring to market.?

Wireless speakers, wireless headphones, Smart TVs and many other device manufacturers will be able to add support for MagicPlay by simply embedding an open source component. doubleTwist Player for Android will be the first application to integrate MagicPlay this Spring. Subsequently, the MagicPlay source code will be released to third-party developers to embed into their apps starting in the 3rd quarter of 2013. Consumers will be able to stream their music to any MagicPlay connected device from doubleTwist Player or any other MagicPlay-compatible app on their mobile device.

MagicPlay is built on top of Qualcomm?s AllJoyn platform, which provides the core building blocks developers need to address discoverability, connectivity, security and management of dynamic, ad-hoc networks between nearby devices.

Qualcomm Extending AllJoyn Software Framework to Drive Interoperability for Internet of Everything

Core Services Being Added to Proximal Networking Software Framework

BARCELONA, SPAIN ? February 25, 2013 ? Qualcomm Incorporated (NASDAQ: QCOM) today announced that its subsidiary, Qualcomm Innovation Center, Inc. (QuIC), will extend the AllJoyn? software development project with new core interoperable services to enable richer experiences for consumers. These new services will be available on devices with different operating systems and from different vendors.

The AllJoyn framework will include new services designed to address fundamental use cases to enable a truly useful Internet of Everything. Today, the AllJoyn SDK provides the core building blocks developers need to address discoverability, connectivity, security and management of dynamic, ad-hoc networks between nearby devices. With the addition of these planned AllJoyn services, manufacturers and developers will be able to utilize higher-level components that implement some of the most common use cases. QuIC expects to release fully functional versions of these core services under an open source license on AllJoyn.org and such services will include:

  • Onboarding ? a ?headless? or other simpler smart device can easily be configured via an intermediary, such as a smartphone application, for use onto a user?s personal network
  • Notifications ? enabling a standard way for devices to broadcast and receive text, image and multimedia notifications
  • Audio Streaming ? facilitating an interoperable, open, wireless audio streaming protocol that allows users to stream their music across products from any manufacturer
  • Control ? allowing for devices to export their control interfaces, including rich graphical elements associated with them

?

These new core services will be upstreamed into the AllJoyn open source project by May 2013. It is expected that many Qualcomm Technologies, Inc. platforms and products will include integrated support for these services as well.

A useful Internet of Everything will emerge when connected products, applications and consumer services can interact via a common communications protocol,? said Rob Chandhok, president of QuIC. ?We are driving toward this vision by adding new core services intended for very broad application but deliberately designed to be simple and basic so that they can be adapted to as-yet unforeseen future requirements. The opportunities for proximal networking in the home and automotive environments are a clear place to start; over time, and with the engagement of the open source community and manufacturers, we hope to extend AllJoyn such that any product with a processor can be made more useful to individuals and enterprises through simple connection and interaction with other devices, regardless of vendor or operating system.?

The audio streaming and notification services will be demonstrated in the Qualcomm booth (Hall 3, Booth #3864) at Mobile World Congress from Feb. 25-28 in Barcelona. The audio streaming demo is via an Android multimedia player application from doubleTwist Corporation and will be showcased with the recently introduced Qualcomm Skifta Audio Module.

'These cuts are wrong. They?re not smart.'

As the country inched closer to the March 1 sequester deadline, President Barack Obama on Tuesday traveled to Newport News, Va., to make a local case for what he and the administration believe will be the devastating economic impacts of the budget cuts.

Obama spoke at Newport News Shipbuilding, which supplies materials to all 50 states and receives Defense Department funding that's being threatened by the across-the-board cuts set to occur in the absence of a budget. He issued specific warnings, noting that tens of thousands of Virginia jobs may be lost; 18,000 fewer Virginians will get the skills and training they need to find jobs; 2,000 Virginia college students will lose financial aid; and early education programs will be eliminated for 1,000 children.

"These cuts are wrong. They?re not smart. They?re not fair. They?re a self-inflicted wound that doesn?t have to happen," Obama told the crowd.

The president called on voters to contact their members of Congress to urge them to compromise and pass a budget to avoid the sequester before the Friday deadline.

"If you agree with me, I need you to make sure your voices are heard," Obama said. "Let your leaders know what you expect of them. Let them know what you believe."

Newport News is a place "where workers will sit idle when they should be repairing ships, and a carrier sits idle when it should be deploying to the Persian Gulf," Obama told governors gathered at the White House on Monday for the National Governors Association's annual meeting.

Tuesday's trip is the latest effort by the White House to argue against sequester. Some Republicans have indicated they would allow it to go into effect should Congress fail to agree on a federal budget that they feel adequately reduces spending and the deficit.

In addition to Obama's speech on Monday to the nation's governors?during which he implored them to urge their congressional delegations to find a budget compromise?the sequester was addressed by Homeland Security Secretary Janet Napolitano during Monday's White House briefing. There, she warned that lines for customs and border crossings will significantly increase and trade will slow down due to spending cuts necessitated by the sequester.

The administration has also warned that food safety inspections and wildfire containment will be in jeopardy, cancer screenings will not be as widely available, air travel will be disrupted and federal prosecutors won't be able to try all their cases, among other negative consequences.

But the administration has been questioned by the media, Republicans and others for identifying these specific consequences when agencies will be able to decide within limitations how to cut their spending.

"They have plenty of flexibility in terms of discretion on how they spend money. There are easy ways to cut this money that the American people will never feel," Republican Sen. Tom Coburn of Oklahoma said on "Fox News Sunday."

Obama has placed the onus on House Republicans to compromise and support tax increases for the wealthiest Americans and some corporations as part of a budget deal.

House Republican Speaker John Boehner on Tuesday directed responsibility for budget legislation at the Democrat-controlled Senate, saying during a Capitol Hill press conference, "We should not have to move a third bill before the Senate gets off their ass and begins to do something. It's time for the Senate to act."

The House passed budget legislation in the former Congress, but it has since expired.

Boehner said Tuesday he's prepared to keep the House in session this week to work with the Senate on a sequester alternative.

Liver stem cells grown in culture: Therapeutic benefit demonstrated

Feb. 25, 2013 ? For decades scientists around the world have attempted to regenerate primary liver cells known as hepatocytes because of their numerous biomedical applications, including hepatitis research, drug metabolism and toxicity studies, as well as transplantation for cirrhosis and other chronic liver conditions. But no lab in the world has been successful in identifying and growing liver stem cells in culture -- using any available technique -- until now.

In the journal Nature, physician-scientists in the Pap? Family Pediatric Research Institute at Oregon Health & Science University Doernbecher Children's Hospital, Portland, Ore., along with investigators at the Hubrecht Institute for Developmental Biology and Stem Cell Research, Utrecht, Netherlands, describe a new method through which they were able to infinitely expand liver stem cells from a mouse in a dish.

"This study raises the hope that the human equivalent of these mouse liver stem cells can be grown in a similar way and efficiently converted into functional liver cells," said Markus Grompe, M.D., study co-author, director of the Pap? Family Pediatric Research Institute at OHSU Doernbecher Children's Hospital; and professor of pediatrics, and molecular and medical genetics in the OHSU School of Medicine.

In a previous Nature study, investigators at the Hubrecht Institute, led by Hans Clever, M.D, Ph.D., were the first to identify stem cells in the small intestine and colon by observing the expression of the adult stem cell marker Lgr5 and growth in response to a growth factor called Wnt. They also hypothesized that the unique expression pattern of Lgr5 could mark stem cells in other adult tissues, including the liver, an organ for which stem cell identification remained elusive.

In the current Nature study, Grompe and colleagues in the Pap? Family Pediatric Research Institute at OHSU Doernbecher used a modified version of the Clever method and discovered that Wnt-induced Lgr5 expression not only marks stem cell production in the liver, but it also defines a class of stem cells that become active when the liver is damaged.

The scientists were able to grow these liver stem cells exponentially in a dish -- an accomplishment never before achieved -- and then transplant them in a specially designed mouse model of liver disease, where they continued to grow and show a modest therapeutic effect.

"We were able to massively expand the liver cells and subsequently convert them to hepatocytes at a modest percentage. Going forward, we will enlist other growth factors and conditions to improve that percentage. Liver stem cell therapy for chronic liver disease in humans is coming," said Grompe.

Cypriot conservative romps to presidential victory

NICOSIA (Reuters) - Cypriot conservative leader Nicos Anastasiades won an overwhelming victory in a presidential run-off election on Sunday, promising to quickly finalize a financial rescue to stave off the island's bankruptcy.

Eight months of inconclusive talks on a bailout package have turned tiny Cyprus into a big headache for the euro zone, triggering fears of a financial collapse which would reignite the bloc's debt crisis.

Anastasiades immediately pledged to hammer out a quick deal with foreign lenders and bring Cyprus closer to Europe, in a shift from the policies of the outgoing Communist government that first sought aid from Russia before turning to the EU.

"We want Europe on our side. We will be absolutely consistent and meet our promises. Cyprus belongs to Europe," Anastasiades told jubilant supporters waving Greek flags and blowing horns. "We will restore the credibility of Cyprus in Europe and internationally. I promise you."

A sea of Greek flags far outnumbered the few Cypriot flags at an indoor stadium where Anastasiades - whose party is proud of its members' ethnic Greek identity - spoke.

The 66-year-old lawyer, known for his no-nonsense style and hot temper, took 57.5 percent of the vote, 15 points ahead of his anti-austerity Communist-backed rival Stavros Malas.

The decisive outcome showed a clear mandate from Cypriots for an aggressive, pro-bailout approach to resolving the nation's financial quagmire, despite growing despondency over austerity measures that will have to accompany any such rescue.

"It's a triumph," said Stefanos Stefanou, a 62-year-old pensioner as he stood outside Anastasiades's campaign offices. "I won't have the fear of losing my pension and benefits now, along with what we earned after working for 40 years."

Financial markets had been hoping for an Anastasiades victory to speed up a joint rescue by the European Union and International Monetary Fund before the island runs out of cash and derails fragile confidence returning to the euro zone.

Virtually all rescue options - from a bailout loan to a debt writedown or slapping losses on bank depositors - are proving unpalatable because they push Cypriot debt to unmanageable levels or risk hurting investor sentiment elsewhere in the bloc.

German misgivings about the nation's commitment to fighting money-laundering and strong financial ties with Russia have further complicated the negotiations.

Anastasiades, a heavy smoker known for his no-nonsense style and who counts fellow conservative German Chancellor Angela Merkel among his contacts, has stressed his pro-European credentials stand him in better stead to seal a deal than the outgoing president, who is the EU's last Communist leader.

In a clear shift with the policies of his predecessor, Anastasiades said one of his first tasks would be to apply for Cypriot membership of the NATO-affiliated Partnership for Peace.

Cyprus's Communist government strongly objected to any NATO links, holding it responsible for what it says was a conspiracy to split the island in 1974.

"We need a government with weight that can talk to (EU) partners, that is cooperative, that can be heard and do what it pledges to do," Christopher Pissarides, a Cypriot who won the Nobel prize in economics in 2010 told Reuters.

"We hadn't been doing this until now. The most important thing is to signal our willingness to cooperate (with the EU)."

EU Commission president Jose Manuel Barroso said he spoke to Anastasiades after the victory and assured him that the bloc was committed to helping Cyprus overcoming its problems.

SOUR NATIONAL MOOD

Anastasiades takes the reins of a Mediterranean nation ravaged by its worst economic crisis in four decades, with unemployment at a record high of 15 percent. Pay cuts and tax hikes ahead of a bailout have further soured the national mood.

His most immediate task will be to appoint a finance minister who can convince Europeans to agree a swift bailout. It is likely to be Michael Sarris, a widely respected former World Bank economist who ushered Cyprus into the euro zone in 2008 as finance minister under a centre-left government.

European officials want a bailout agreed by the end of March, ensuring no honeymoon period for the new president, who will be sworn in on February 28 and assume power on March 1.

Talks to rescue Nicosia have dragged on since June, after a Greek sovereign debt restructuring saddled its banks with losses. It is expected to need up to 17 billion euros in aid - about the size of its entire economy.

Anastasiades has suggested the island may even need a bridging loan to tide it over until a rescue is nailed down.

Turnout was lower than expected among the half a million Cypriots eligible to vote, with a 19 percent abstention rate blamed on despondency at the country's grim prospects.

Longstanding anger over the island's 40-year-old division into the Greek-speaking south and Turkish north has been relegated to a distant second behind the country's financial quagmire as an election issue this year.

"Cyprus has to move forward," said Marios, an 18-year-old army conscript who declined to give his last name for fear of violating army rules.

"We were prospering but in the last five years we started going backwards."

Maldives denies deal with ex-president

THE Maldivian government denied any deal to allow ex-president Mohamed Nasheed to end his refuge at the Indian embassy in the capital and resume election campaigning without fear of arrest.

Presidential spokesman Abbas Riaz said Nasheed walked out of the embassy on Saturday afternoon of his own will and there was no agreement with an Indian mediator who rushed to the Maldives last week to resolve a tense standoff.

"There is no deal, absolutely no deal with the Indians or anyone else," Riaz said on Sunday, in the government's first reaction to Nasheed leaving the embassy to resume his political work.

Nasheed, 45, sought refuge at the embassy on February 13, straining ties between regional power India and its small neighbour Maldives, after an arrest warrant was issued following his failure to attend court.

He says his trial is a "politically motivated" attempt to disqualify him from an election due on September 7, a charge denied by the government.

The opposition Maldivian Democratic Party (MDP) said Nasheed was meeting with visiting Western diplomats on Sunday and would start house-to-house campaigning from Monday.

"He is back on the campaign trail," said MDP spokesman Hamid Abdul Ghafoor.

"India arranged a deal to give political space for Nasheed to contest... but still there is a risk (of arrest). We don't trust this rogue regime."

The Maldivian government insists that it will not interfere with a judicial process.

India sent its special envoy, senior diplomat Harsh Vardhan Shringla, to mediate an end to the crisis after Nasheed took refuge in its high commission to avoid arrest.

CSN: Phils trade Schwimer to Jays for minor leaguer

CLEARWATER, Fla. ? Michael Schwimer knew something was up when instead of being brought into the game to pitch his scheduled inning Saturday he was summoned to the clubhouse to speak with assistant general manager Scott Proefrock.

Schwimer, a 27-year-old reliever, was traded to the Toronto Blue Jays for minor-league first baseman Art Charles.

According to both Schwimer and Phillies GM Ruben Amaro Jr., a dispute between the pitcher and the team over an injury late last season had nothing to do with the team?s decision to move the reliever who finished third in innings pitched in the Phillies? bullpen last season.

Amaro said a glut of relievers, the desire to add power potential to the system, and potential issues with roster space led to the deal.

Schwimer said the Phillies made the deal to better their club now or in the future and added that the Phils weren?t a team that would ?let any petty differences affect them wanting to win.?

Still, one has to wonder if the relationship between the two sides impacted the parting. Pitching coach Rich Dubee described Schwimer as ?an arm that should pitch in the big leagues if he sticks to doing things the right way instead of being too macho at times and coming out of his delivery.? Schwimer had options remaining, meaning he could have been sent to the minors. There was no overriding pressure to trade him.

Schwimer pitched in 35 games for the Phils last season and was sent to the minors in late August. The pitcher initially balked at the assignment, saying he had a shoulder injury. Players who are injured can?t be sent to the minors, per Major League Baseball rule. Phillies medical personnel said Schwimer was not injured. The pitcher sought outside medical opinions and the Players? Association investigated whether the Phillies had violated the basic agreement.

Though Schwimer reported to camp healthy, he admitted that his injury dispute with the Phillies remained an open issue.

?Nothing has been filed,? he said, meaning an official grievance. ?But as far as I?m concerned it?s definitely an open issue.?

If a grievance is filed and Schwimer wins, he could get back pay and service time.

?There?s a lot of things I can?t get into,? Schwimer said of the dispute. ?What I will say was there was definitely a disconnect in communication. It was nothing personal against them. It was nothing personal against me. As a young player you really don?t know how to handle certain things and in their opinion I handled things the wrong way, and in my opinion they handled things ? It was just a communication difference.?

Despite the situation, Schwimer said he was grateful to the Phillies.

?This is a business,? he said. ?Everybody has to do what they think will make their team better. I respect their decision completely. I absolutely loved my time with the Phillies. I loved the teammates I had and the team. I hope we meet in the World Series. It?s been a great time and a great ride.?

Amaro said, ?There?s nothing wrong with Schwim. He?s a great kid. We have some depth with our young bullpen arms and we are going to have some roster issues down the pike. We could have waited, but we felt this was the right thing to do right now for us.?

Charles, 22, is a 6-foot-6 lefthanded hitter with power. He was a 20th-round draft pick in 2010. He has a .239 batting average, an OPS of .840, and 28 homers in 585 minor-league at-bats. He has never played above Class A.

?He?s got big pop,? Amaro said. ?Whether he?s going to be a major league hitter at some point, we don?t know. He?s a big kid and a pretty decent athlete. He hits home runs and has a lot of strikeouts and a lot of walks. We?ll see. We?re taking a chance on a guy.?

FBI part of Australia SuperDae home raid concerning Microsoft corporate espionage

A Perth, Western Australia teenager known online as ?SuperDae? recently had his family?s home raided by the U.S. Federal Bureau of Investigation.? The raid was over intelligence the young man, who is purportedly a hacker, had somehow acquired on the upcoming Xbox gaming system.? The FBI working with the Western Australia police seized many of the young man?s possessions, which included all of his computer equipment.? He is being accused of international corporate espionage.?

This raid came many months after the teen revealed information regarding the upcoming Xbox via his highly popular Twitter account.? Dylan, whose last name was withheld over privacy and age, is a highly popular social media user and has nearly 30 thousand followers on his Twitter account.? Dylan also posted online a new development kit for the ?Durango?, which is what the new Xbox design will be called.

The development kit is what companies receive from a video game maker to help them create and develop new games for their system.? Because of Dylan?s leak, it caused a lot of chatter in cyberspace with designers and other developers since this type of information is usually kept very secret.

Dylan told The West Australian press that the sudden raid was a highly charged and frightening experience to go through for his entire family.? He said when he heard the knock, the FBI were literally about to ram the door open.? The FBI also insinuated to him that he may very well be extradited to the U.S. depending on the outcome of the investigation.

The West Australian further confirmed that the raid did occur through the local WA police department.? When asked for more information regarding the FBI?s role in the ordeal, they refused comment, but did say that their tech crime investigation unit was involved in a type of multi-jurisdictional investigation into the alleged corporate espionage.

Dylan, a.k.a. SuperDae, considers himself to be a security consultant for any type of flaws found in programs or online sites.? He said that he only published the intelligence over the Durango Xbox to show that it was possible to do so.?? He claims that he was in contact with Microsoft over the flaws in their security, but he said he ceased communication when he felt they were only using him without any form of reimbursement or thanks.

It isn?t known at this time if Dylan will be extradited to the U.S. or if the espionage case will begin to grow.? His case has just begun to make the rounds on Twitter and the hash tag #FreeSuperDaE has also begun trending with the hacker community.?

Giggs scores for United in his 999th game

Associated Press Sports

updated 4:29 p.m. ET Feb. 23, 2013

LONDON (AP) - Ryan Giggs scored in his 999th match by scoring in another age-defying, influential display to help Manchester United go provisionally 15 points clear at the top of the Premier League.

A late goal from the Welsh midfielder followed a fine strike by defender Rafael da Silva in a 2-0 victory over last-place Queens Park Rangers.

"He's delivered again," United manager Alex Ferguson said of the 39-year-old Giggs. "He's an amazing man."

Even if second-place Manchester City beats Chelsea on Sunday, Giggs seems headed for a 13th league title at the club where he has spent his entire career.

For traditional rival Arsenal, the season is mainly coming down to salvaging a place in the Champions League places.

And the north London club did manage to put its recent cup disappointments behind it with a 2-1 win over Aston Villa to go provisionally a point behind fourth-place Tottenham. Santi Cazorla scored twice against U.S. goalkeeper Brad Guzan either side of Andreas Weimann's goal for Villa.

Villa sunk back into the relegation zone with Wigan, which lost 3-0 to Reading and QPR.

Sixth-place Everton fell five points behind Arsenal after losing 2-1 at Norwich, and West Bromwich Albion rose to seventh by beating Sunderland by the same score.

Fulham defeated Stoke 1-0 thanks to Dimitar Berbatov's crisp volley right before half time.

Stoke forward Jonathan Walters missed a second-half penalty after Ashkan Dejagah had blocked a cross from Brek Shea with his arm.

Shea, a United States winger, replaced the injured Matthew Etherington in the 24th minute to make his first appearance for Stoke since joining from Major League Soccer club FC Dallas last month.

BERLIN (AP) - Bayern Munich routed Werder Bremen 6-1 to maintain its march to the German title and help Jupp Heynckes celebrate his 1,000th Bundesliga game as player or coach.

The 67-year-old Heynckes, who will be replaced by Pep Guardiola next season and has signaled his intention to retire, was presented with a bouquet before kickoff in Munich to mark his achievement. Only Otto Rehhagel, with 1,037 games, has more.

Heynckes made six changes to the side that won 3-1 at Arsenal in the Champions League on Tuesday, giving Arjen Robben and Mario Gomez rare starts.

Robben seized his chance by scoring in the 25th and sent in a free kick for Javi Martinez to double the lead with a header four minutes later.

Sebastian Proedl was sent off for bringing down Gomez when the striker was through on goal.

Bayern moved provisionally 18 points clear of Borussia Dortmund ahead of the defending champion's visit to Borussia Moenchengladbach on Sunday. The sides meet in a German Cup quarterfinal in Munich on Wednesday.

---

ATHENS, Greece (AP) - Dimitris Salpingidis scored twice within eight minutes in the first half - both times with overhead kicks - and Klaus Athanasiadis added another in between to lead PAOK to a 3-1 win over last-place Kerkyra in the Greek league on Saturday.

The win helped PAOK rise into second place, 14 points behind league leader Olympiakos, which hosts Aris on Sunday, and two ahead of Asteras, which can reclaim second place if it beats Levadiakos at home on Sunday.

---

GLASGOW, Scotland (AP) - Inverness reclaimed second place in the Scottish Premier League by beating Hearts 3-2 on Saturday.

Inverness went a point ahead of Motherwell, which lost 3-0 at Ross County, and St. Johnstone, which beat St. Mirren 1-0.

Celtic is 18 points ahead of Inverness at the top of the SPL as the Glasgow side tries to defend its title.
