Soldier acquitted of negligent homicide in hazing trial

A military jury found a U.S. Army sergeant not guilty on Monday of negligent homicide in the death of a Chinese-American soldier who officials say killed himself in Afghanistan after enduring hazing and racial slurs.

Sergeant Adam Holcomb, 30, was the first of eight soldiers to face a court martial in connection with Private Danny Chen's death in October 2011.

The military panel that heard Holcomb's case in Fort Bragg, N.C., found him guilty of maltreatment and assault, but acquitted him of both negligent homicide and harassment, base spokesman Thomas McCollum said.

Holcomb was expected to be sentenced later on Monday.

Chen, 19, killed himself by gunshot in a guard tower in southern Afghanistan, where military prosecutors said the weeks of physical mistreatment and racial harassment he encountered from his superiors pushed him to take his own life.

Holcomb, who pleaded not guilty to all the charges, was accused of referring to Chen by racially derogatory names such as "dragon lady," "Jackie Chen" and "egg roll."

Danny Chen was born in New York and raised in the city by his Chinese immigrant parents.

According to testimony, Holcomb also caused injuries to Chen's back by dragging him across gravel after the lower-ranked soldier left a water pump on in a shower at their remote base in Afghanistan.

Holcomb's attorneys argued that Chen killed himself because he was struggling as an infantryman and had been disowned by his parents for joining the Army ? an assertion Chen's mother and father denied from the witness stand last week.

In the fast paced world that we live in it can be easy to neglect our health and wellness. We?re so busy racing through our day to day lives ? family, friends, work, social engagements ? that we don?t take the time to look after ourselves. It?s really no wonder that so many of us are tired and run down. What are some simple things that we can do to improve our quality of life?

Drink Drink Drink?

You?ve heard it a million times and you?ll probably hear it a million more ? drink more water!

Think about it: The human body is 72% water. A 5% drop in fluids creates a 25-30% loss in energy. A 15% drop in fluids causes death! At this point in time 66% of us aren?t drinking enough water, so over half the population isn?t running on all six cylinders to begin with ? before things like bad air, bad food and stress take their toll.

It?s not really a difficult thing to remedy. Just drink one glass of water every half hour or so ? or 10-12 glasses of water per day ? and you?ll notice a huge jump in your energy levels.

Living Food ? Loving Life!

A little known fact is that heating food above 116?F destroys much of the nutrient content. Considering that we already aren?t eating enough veggies, that?s a fairly substantial problem. Nutritionists recommend five serves of fresh vegetables per day. How many of us are actually taking that advice?

A great way to get the nutrients found in fresh veggies without spending all day at stove or eating raw celery sticks is to juice your veggies. Make sure that you own a good juicer (some juicers expose vegetables to heat created by friction during juicing, which breaks down important enzymes), grab some fresh vegetables and drink your way to good health. It takes a fraction of the time (there?s no cooking involved, for one thing) and it?s convenient. You can take your juice to work and even give some to the littlies for school lunches!

Wheatgrass in particular is an excellent source of nutrition. It?s high in chlorophyll (sometimes described as ?plant blood? because it closely resembles human red blood cell molecules) and has over 100 elements that the body needs. Fresh grains are another excellent source for vitamins and minerals.

Energy In ? Energy Out

Exercise is another dirty word for most of us. The thing is, exercise doesn?t have to be horribly time consuming or mind-numbingly boring. There are plenty of options.

Years ago gyms usually offered weight rooms, aerobics classes and maybe a tydro-circuit. Now you can add water aerobics, yoga, pilates, dance-ercise, step classes and a whole range of new workout options.

If you don?t really have the time or money for the gym, or prefer to spend your mornings/nights at home, then try an exercise bike or walker. I?d be lost without my exercise bike ? I set it up in front of the television and peddle away merrily during my favourite shows.

If, like me, you suffer from illness or injury or your level of fitness is quite low, you might like to consider some invaluable advice that I got from my doctor:

Once you?re physically unfit, and particularly if you?re also unwell, it can be a mammoth battle to just do the most minimal amount of exercise in a day. The danger is that inactivity leads to further loss of energy, which becomes a self-perpetuating cycle until you can barely get off the couch.

An excellent way to get back into a physical routine is to start slowly. Ridiculously slowly, it may seem. For the first couple of weeks, walk/ride for 5 minutes per day ? exactly 5 minutes, no more, even if you think you could continue. When the 2 weeks are up, increase to 7 minutes, then 10 minutes, 12 minutes? continue to gradually increase your activity until you?re at a level that you?re comfortable with.

It may sound a little silly, but it works. In effect, you trick your body into producing more energy. You?re building your exercise time up so slowly that your body doesn?t really realise what?s happening. Follow this method and, before you know it, you?ll be comfortably exercising within your limits every day.

So, folks, that?s the basics. If you can rearrange your life a little to allow for better eating habits and a little exercise, and if you remember to just drink a glass of water every half hour or so, you?ll be well on the way to living a healthy life. On a final note, don?t forget to take some quiet time for yourself. Meditating is an excellent way to minimise stress. You don?t have to sit around for hours, just give yourself 5 minutes of quiet time every day ? even in the shower, if that?s the only place where you can get time out ? and have a little catch up with yourself.

And, last but by no means least, laugh! In fact, laugh like a loon ? the louder the better! You?ll be amazed at how much such a simple thing can lift your spirits!

They were supposed to make everything better. And maybe they did, a little. But it's time for them to go away now. Sorry, QR codes. It's been real.?

?1. QR Codes

Imagine a hyperlink, except instead of actual readable text that you can type in, it's some weird ziggurat that gives no hint of where it's going. Also, instead of clicking on it, you have to take a picture of it with your camera, and you're probably going to have to take that picture three or four times before it works, and a lot of the time it's going to send you to either a non-mobile site or a dead link. If they all disappeared tomorrow, not one person in the entire world would care, not at all.

2. Routers

For some reason, they all look like they were made in 1995 and most of them act that way too. Everything they do would be much better in a scaled down, Airport-Express-style dongle. Time to burn this one down and start again.

3. Browser plugins

Flash is pulling out of the mobile world (after years of trying to break in) and Silverlight is ruining lives on a daily basis. Soon HTML5 will replace them entirely ? browser plugins don't exist on the iPhone or iPad and they won't exist on Windows 8 RT ?? but in the meantime there are a lot of websites with gaping holes in them, like a newspaper attacked by old lady clipping coupons.

4. Traffic cameras

The?rule was, if a cop caught you speeding, you got a ticket. It was a great system, both for the Smokey-and-the-Bandit factor and because, if you were only a little bit over the line, the officer would usually let it slide. Mailing tickets to people just because they got from point A to point B a little ahead of the curve is cheating, and it moves us towards a creepy automotive panopticon where the force of law is both intangible and omnipresent. But mostly, it's just lame.

5. Inductive charging?

Another idea that's been kicking around for a while without ever taking off. If it's not built into the phone, like the Palm Pre, it's not any easier than plugging it in.

6. Bluetooth audio

This started out as a good idea ? especially the speakers ? but it took 15 years to produce a decent product. Time to call it a day. We're better off with speaker wire.

7. The remote control

True story: I recently visited a friend who was housesitting, and it took us 10 minutes to figure out how to turn on the TV. There were three remotes, and each one had 40 buttons on it, except for the Apple TV remote, which didn't have a power button. Just put it in an app.

8. The cable box?

Speaking of which, here's a strange box that requires another remote control. Destroy! Or get it over with and shove it inside of an?Xbox or Apple TV already.

9. Software license keys?

Hard to enter, easy to crack. Authentication shouldn't be this difficult.

10. Cables For everything

Too many cables. Toomanycables. Too many, cables. Too.?Many cables.

11. The printer/scanner/fax

A surprising number of people still get one of these when they buy a computer, even though there's no reason to do any of these three things, and if you ever run out of ink or toner you will suffer the tortures of the damned. The sooner we stop expecting paper copies of things, the better.

12. Blu-Ray?

A lot of loose copies of Transformers 3 were handed out trying to make this one happen. And the movie looked great! Unfortunately, nobody you know owns a Blu-Ray player, and nobody wants to make a computer that deals with them. You're better off streaming.

13. The power brick

It's enough to make you wish we'd stuck with direct current.

14. Facebook comments

Designed to bring civility to web comments by attaching real people's names to them. Because if you know Richard Morris here is the person saying crazy things, he won't say them, right? Wrong. It continues to be a bottomless will of spiritual death and plain-old web-design misery.

15. Standalone anti-virus software?

It's crazy that this still exists. Just bake it into the OS already.

We know it didn't take much time for the Tenth iteration of that CM greatness to reach Google's popular Nexus 7 and Samsung's most colossal Galaxy handset on the block, but one other Android big shot was still yet to join the "preview build" bash. The marvelous news is Verizon Galaxy Nexus owners can now also take part in the early adoption process, as CyanogenMod's Brint Kriebel has said via Mountain View's social network that CM10 for Big Red's GNex is out and up for grabs. That said, he's let it be known the goods aren't exactly fully baked, though he has been rockin' it as his "daily driver" for about two weeks -- which, needless to say, is quite a good sign. Gen. Martin Dempsey, chairman of the Joint Chiefs, on how to cut nearly $500 billion and still keep the military healthy.

On a desk once used by Douglas MacArthur, Joint Chiefs of Staff Chairman Martin Dempsey keeps a small wooden box engraved with the words ?Make It Matter.? Inside are cards containing the photos and brief biographies of the more than 130 soldiers he lost in Iraq as commander of the Army?s 1st Armored Division. As he shepherds the military into the austerity era, Dempsey finds all the inspiration he needs in the box. NationalJournal Senior Correspondent James Kitfield spoke recently with Dempsey in his Pentagon office. Edited excerpts follow.

NJ The American public is understandably war-weary and focused on the domestic economic crisis. How do you explain to them that the threats the country faces continue to demand a strong U.S. military?

DEMPSEY I describe the period we?re entering as a security paradox. On the one hand, there are some deep thinkers who argue that violence around the world is actually at a historic low, with fewer people dying violently each year than during any period in history. On the other hand, I look at incidents such as the terrorist attacks in Mumbai, India, in 2008. That operation was controlled by an operations and intelligence fusion center in Pakistan that used commercial, off-the-shelf technology such as Google Earth?s real-time mapping, satellite communications, GPS, BlackBerry texting, social media, and rapid Internet searching. And enabled by that technology, 10 terrorists were able to kill 200 people and wound another 300 in an operation that took Indian security forces three days to end. Similarly, the ?Great Train Robbery,? so famous from the 19th century, involved two guys robbing a trainload of some 100 people. Today, one guy with a laptop can literally rob 100,000 people of their wealth or intellectual property. So the ability to commit violence and do harm is proliferating along with technology, and I want to be very clear-eyed about that growing threat. The world we are entering is one that feels safer on some level, but is actually much more dangerous.

NJ What technologies or capabilities will the U.S. military need to master in this era?

DEMPSEY If I look at the benchmark year of 2020, which is the military I will be responsible for helping shape, my big ?Aha!? moment as chairman has been the realization that about 80 percent of that force is essentially on autopilot due to decisions already made. That has freed me to focus on the 20 percent I can change, especially new capabilities that we didn?t even have 10 years ago. The ones that jump out at me are ISR [intelligence, surveillance, and reconnaissance], bigger and more capable special forces, and cybercapabilities.

NJ During past drawdowns, budget pressures upset the balance between priorities such as force structure, weapons modernization, manpower, and readiness. Can you keep those pillars balanced even as you absorb nearly $500 billion in reductions over the next 10 years?or $1 trillion if sequestration kicks in?

DEMPSEY We can provide the security the nation needs with the plan that the service chiefs and combatant commanders have all agreed to. National power is an aggregate of diplomatic influence, military capability, and economic power. When any one of those three legs is weakened, the whole foundation is shaky. So I?ve said publicly to our service members and their families that we have to demonstrate to the American people that we can be part of the solution to our economic problems. On the other hand, if sequestration is triggered, the cuts become so automatic that it throws the force out of balance right away.

NJ Do you see any of your biggest budget accounts taking priority?

DEMPSEY We absolutely have to get the people part right. If you look back at the interwar years before World War II, [Army chief George] Marshall invested the resources he had in people, sending the best and brightest people to the service schools, even though they had to exercise with wooden guns and tractors because they didn?t yet have rifles and tanks. Today, we have to continue to inspire the kinds of young people who have joined in the last 10 years to fight for their country. At the end of my time in uniform, if someone tells me I managed to get the people piece of this puzzle right despite a really ugly environment, I?ll be satisfied.

NJ Experts say that the per-person cost of the all-volunteer force has jumped 46 percent over the past decade.

DEMPSEY We?re trying to find ways to make the all-volunteer force more affordable, but it?s not easy and we need Congress?s help. There?s also the matter of necessity: The alternative to the all-volunteer force is some kind of draft, which is appealing on some levels but probably impractical. I would also argue that the all-volunteer force has proven incredibly resilient. There are some horrible statistics on suicide and other behavioral health issues, which are completely unacceptable?but, overall, the force remains strong. If you had told me when we were back in Baghdad nearly a decade ago that the force would keep up that pace for 10 more years, and overall our people and our families would remain strong and proud, I would have said you had been drinking!

NJ During the post-Vietnam drawdown of the 1970s, the Pentagon infamously favored force structure and modernization at the expense of readiness, leading to a ?hollow force.? The Army also largely expunged the lessons of counterinsurgency after Vietnam. Has the military internalized the lessons from those mistakes?

DEMPSEY On readiness, the short answer is yes. Because we lived through that experience, most flag-rank officers are committed to the premise that no matter what size force we maintain, we will keep it in balance. Nor can we allow the lessons in counterinsurgency operations learned over the past decade to be lost. Right now, however, I have the opposite problem. If you are a lieutenant colonel or sergeant first class in the Army today, for instance, you don?t know anything else except counterinsurgency. And that?s not the only type of conflict we need to be prepared for.

NJ The national-strategy guidance says that the military will no longer be sized for large-scale, prolonged stability operations. It will cut 100,000 ground forces in coming years. Doesn?t that mean no more Iraq- or Afghanistan-like campaigns?

DEMPSEY Not really. We like to think we can pick our conflicts, but in reality, conflict picks you. There is still the thorny matter of our alliance with the Republic of Korea. That scenario certainly has the potential for significant land forces and stability operations. What we have tried to do with the new defense strategy is anticipate a decline in resources, and consider how we might leverage cutting-edge technologies to accomplish our current missions differently. And if we did get into another large, long-term stability operation, it would probably require us to access the National Guard and Reserves in ways we haven?t in the past.

NJ When Congress refuses to let you close bases, cancel weapons programs, or cut medical benefits, do you worry about your ability to keep the force in balance?

DEMPSEY That does concern me, but it?s a condition I don?t control. My moral compass requires that I provide civilian leaders in the Pentagon, White House, and Congress with an honest assessment of the impact of maintaining too much force structure or unnecessary weapons systems. At the end of the day, this is a democracy, and they will decide. However, I won?t shrink from explaining the impact of those decisions, and hopefully I?ll be persuasive.

NJ America has a long tradition of cutting defense too deep for too long during postwar drawdowns, and of sending brave but unprepared troops into battle in the next war. Can you break that cycle?

DEMPSEY Although those first battles of past wars have proven too costly, in each case American military leaders and forces adapted and ultimately prevailed. When I finish in this job, my personal measure of success will be whether or not I and the service chiefs developed leaders that are adaptable. That?s the attribute we value more than ever before, because the next time we predict the future wrong in terms of where, when, and who we are going to fight?and we will get it wrong again?we will need to adapt to prevail.

Panetta heads to Mideast; Syria high on the agenda

ABOARD A US MILITARY AIRCRAFT (AP) ? U.S. Defense Secretary Leon Panetta began a five-day Mideast trip Sunday to consult with the new Islamist leaders of Tunisia and Egypt and to meet with long-standing allies Israel and Jordan.

High on the agenda at each stop is expected to be the accelerating crisis in Syria, which potentially has grave implications for Israel. The Jewish state fears the unrest will spill over the border and that the long-quiet Golan Heights, captured from Syria in 1967, will become a new Islamist front against Israel.

Syria has strong ties to Iran, Israel's most fearsome enemy, and to Palestinian and Lebanese militants who have warred with Israel. Jordan's worries include a potential refugee crisis on its border.

Panetta's press secretary, George Little, said the trip is intended to affirm a U.S. commitment to stability in the Middle East and North Africa at a time the U.S. military is shifting more of its attention to Asia.

"That will require strengthening traditional alliances with countries like Israel and Jordan and building strong partnerships with new democratic governments," Little said last week in previewing the trip.

Panetta will be in Jerusalem just days after a visit by U.S. Republican presidential hopeful Mitt Romney, who has been highly critical of President Barack Obama's approach to Israel.

Panetta is expected to highlight U.S. cooperation with Israel on building more effective missile defenses, including the Iron Dome system that is designed to shoot down short-range rockets and artillery shells. That air defense system was developed in response to Israel's 2006 war with Hezbollah militants in Lebanon, who fired thousands of rockets, mostly short-range Katyushas, into northern Israel. The U.S. has provided $205 million for the project, and on Friday, Obama announced the release of a further $70 million.

In Tunis, Panetta plans to meet with his Tunisian counterpart as well as President Moncef Marzouki, leader of the small, secular Congress for the Republic party.

Panetta is scheduled to visit the North Africa American Cemetery near Tunis, resting place for 2,841 U.S. military members killed in the World War II invasion and occupation of Morocco, Algeria and Tunisia in 1942-43. Garrigus sets record and takes lead in Canada

ANCASTER, Ontario (AP) ? Robert Garrigus would have made Arnold Palmer proud Saturday at the Canadian Open ? for the way he treated the people, and for the scores on his card.

Garrigus combined his power with a couple of timely putts at rain-softened Hamilton for a 6-under 64, breaking the 54-hole scoring record at golf's third-oldest championship that was first set more than a half-century ago by Palmer. Equally impressive was when he didn't even have a club in his hand.

After a routine par on the sixth hole, Garrigus walked over to a volunteer and said, "Thanks for being here." After he chunked a wedge into a bunker on the seventh, one of his poorer shots of the third round, he found another volunteer behind the green and said, "Appreciate what you do for us."

It's the kind of stuff that made Palmer the King.

"It makes me feel good just to say it," Garrigus said. "Like I said, it's on their dime. And we need the fans. We need the volunteers. We need the sponsors, and a lot of guys out there don't lean that way to thank the volunteers. I've had hundreds of volunteers come up to me and say, 'Thanks for saying thank you.' That means a lot."

Now if he can just finish like the King.

Garrigus had a one-shot lead over William McGirt, who played with poise with his name atop the leaderboard for the first time on the weekend at a PGA Tour event. McGirt had a 66 and actually lost ground, going from a share of the lead to one-shot behind. He will be in the last group with Garrigus.

Garrigus was at 16-under 194, one shot better than Palmer in 1955 at Weston Golf & Country Club in Toronto, and matched two years ago by Dean Wilson at St. George's Golf & Country Club, also in Toronto.

"Oops. Sorry, Arnie," Garrigus said when told about the record.

Palmer, however, went on to win the 1955 Canadian Open for the first of his 62 titles on the PGA Tour. Garrigus will be going for his second win, though this tournament is a long way from being settled.

Garrigus was fortunate to escape with par, not to mention his health, on the final hole when his 3-iron off the tee ran out 290 yards and just short of the bridge. Because he was inside the hazard, he couldn't ground the club and had a rules official make sure the bridge wasn't beneath the ball. It was a few inches ahead of the ball.

"If I hit it a millimeter fat, I break my wrist," Garrigus said. "I had to knife it out of that lie and catch part of the bridge, and hopefully the ball gets the top part of the bridge and bounces up. And that's exactly what I did. I hit it perfect."

Scott Piercy had a 67 and was two shots behind.

Scott Stallings, who won last week in Mississippi, birdied his last two holes for a 63 and was four shots behind, along with Chris Kirk (63) and Bo Van Pelt (67). Stallings ended a streak of nine consecutive PGA Tour events in which the 54-hole leader failed to win. The ninth was Ernie Els coming from six shots behind at the British Open. Stalling won later that day.

"A lot of guys haven't been able to hold leads this year," said Garrigus, still known for losing a three-shot lead on the final hole in Memphis two years ago.

No matter the difficulty of any course ? Hamilton rates among the best in the Canadian Open rotation ? soft greens are no match for the best players. And now, the 72-hole record at the Canadian Open is in jeopardy. That belongs to another Palmer ? Johnny Palmer ? who had a 263 in 1952 at St. Charles in Winnipeg, Manitoba.

Garrigus' goal?

"Foot to the floor, as much as possible," he said.

He wasn't speaking about the scoring record as much as leaving town with the trophy, which would put him in a World Golf Championship next week at Firestone and the Masters next April. He might not have a choice the way scoring has been this week.

McGirt, who started the day atop the leaderboard for the first time in his career, was never more than two shots behind. That came on the par-3 13th, when his tee shot came up well short and into a bunker, leading to his lone bogey. He atoned for that with a birdie on the next par 3 at No. 16, and recovered from a poor tee shot with an up-and-down from some 45 yards short of the 18th green.

Garrigus wasted no time joining the chase with a 316-yard tee shot that left him only a 5-iron that he stuffed inside 3 feet on the 530-yard fourth hole. He followed by driving through the green on the 329-yard fourth hole into a back bunker for an up-and-down, then made another strong move around the turn with three birdies in a four-hole stretch, courtesy of a couple of tricky putts.

The third round started late and in threesomes to cope with overnight rain, though Hamilton began to dry out in the afternoon. Proof of that was the 3-iron Garrigus hit off the 18th tee to stay well short of the creek. He was stunned to see it go through the fairway near the bridge.

The forecast Sunday is for sunshine, which could make Hamilton the test it typically is.

Kirk, who began the third round six shots behind. Starting with the third hole, Kirk made seven birdies in an eight-hole stretch. He was 7 under for his round with eight holes remaining, needing birdie on half of them for a 59. He was never thinking about golf's magic number, though, which was a good thing. He closed with eight pars, and he was OK with that.

"I was just trying to keep my head down and keep going," he said. "When you have those days where everything is going in the hole, you make as many as you can."

DIVOTS: Vijay Singh, winless on the PGA Tour since 2008, started the third round three shots behind and had a 69. He was seven shots out of the lead. ... William McGirt and his wife, Sarah, are expecting their first child in January. That might make it tough for him to get to Kapalua if he were to win on Sunday, a nice problem to have. ... Steve Jobs never had much tolerance for employees who leaked the company's plans, but on one occasion, it was actually Jobs who came close to blowing the lid off a product, according to a former employee we spoke with.

Shortly before Jobs and Apple unveiled the original iPhone at MacWorld in 2007, a group of engineers from the iPhone team went to Jobs' home to debug a problem with the phone's WiFi.?

At one point while the team was working, a FedEx employee buzzed outside the house to deliver a package to Jobs.

"Steve goes out to meet him because he has to sign for this package, but he's got the iPhone in one of his hands," said a former Apple employee was with the iPhone team at the time. "Steve just walks out casually, [hides] the phone behind his back, signs the package, and the FedEx dude marches off."

The idea that Jobs would walk outside carrying an iPhone in plain sight shocked this employee, given how much effort Apple put into keeping the product secret at all costs.

"You have to understand, when we carried the phones to his house, we carried them in these Pelican lock boxes," the employee told Business Insider. "These phones were never to leave Apple's campus, and Steve just casually throws it behind his back. That was the first time I saw someone casually come close to seeing the iPhone before it was announced, and he didn't even know it. If the FexEx guy had just tilted his head, he would have seen it."

Here's the full story, as told to us by the employee:

We had a problem with the WiFi on an early build of the iPhone. Steve had this house that was just a no man's land for WiFi, with thick walls. It finally got to the point where we were fried and panicky because MacWorld was coming up, so we decided to go and debug at Steve's house.

When we got there, Steve was sitting in his car in the driveway rocking out to some really loud music. The car was off, he was just listening. Sprint Posts Q2 2012 'Earnings'

Sprint has posted their Q2 2012 results and boy was it quite the bucket of information to get through. There's lots of numbers and some tricky accounting involved, but here are the main points:

  • Net loss of $1.4 billion, which calculates out to $0.46 per share.
  • Wireless service revenues of $7.3 billion for the quarter, up 8-percent year-over-year.
  • ARPU (Average Revenue Per User) growth of $4.31, the highest on record for the U.S. wireless industry.
  • Net postpaid customer additions of 442,000, with a best ever churn performance of 1.69-percent.

Now, let's talk about what those numbers actually mean. If you read into the press release, Sprint CEO Dan Hesse made the following statement:

The Sprint platform achieved best ever postpaid ARPU and customer churn that, combined with disciplined customer acquisition and cost management, contributed to our Adjusted OIBDA of $1.45 billion. Based on this performance, we are raising the 2012 Adjusted OIBDA forecast to between $4.5 billion and $4.6 billion.

That's a lot of fancy mumbo-jumbo to all of the non-financial types, but we can break it down a little bit. OIBDA means Operating Income (or loss) Before Depreciation and Amortization. Some more financial speak, we know, but bare with us. In basic terms, the OIBDA numbers don't include a lot of the required accounting, depreciation and expected future losses. This is the big reason why Hesse is quick to point out these OIBDA income numbers. They simply -- well, maybe not so simply -- paint a much nicer picture of Sprint's financials. Between Sprint's "Network Vision" and Clearwire investment alone, they have written-down $986 million in losses for Q2. OIBDA numbers, strategically, don't consider these losses because they do not actually influence Sprint's cash flow or bottom line this quarter. Sprint will be quick to point out that even though they technically lost $1.4 billion in Q2, in terms of cash flow and buying power for future capital expenditures and spectrum acquisitions, they're doing quite well financially.

Whatever the accounting technique, its hard to ignore the big red numbers coming through in Sprint's financial statements every quarter. Let's hope that their expanding LTE network and devices can bring them back into the black sooner rather than later.

McKesson to pay $151M to settle drug-pricing suit

(AP) ? McKesson Corp. will pay $151 million to 29 states and the District of Columbia to settle a lawsuit alleging the company inflated prices of hundreds of prescription drugs, causing state Medicaid programs to overpay millions of dollars in reimbursements, officials said Friday.

The agreement with San Francisco-based McKesson, one of the country's largest drug wholesalers, settles allegations the company deliberately inflated drug prices by as much as 25 percent from 2001 to 2009.

An investigation by state and federal agencies found that McKesson overbilled for more than 1,400 brand-name drugs from 2001 to 2009. They include commonly prescribed medications such as Adderall, Allegra, Ambien, Celexa, Lipitor, Neurontin, Prevacid, Prozac and Ritalin, officials said.

California will receive about $24 million of the settlement, said state Attorney General Kamala Harris. That money will go to the state Medicaid program, not recipients.

"In these difficult budget times, it is crucial that California's scarce public resources support the urgent needs of our state," Harris said in a statement. "We cannot allow dollars meant for patients to be diverted to inflate corporate profits."

McKesson representative Kris Fortner said the claims against the company are without merit, but "given the inherent uncertainty of litigation, we determined that this settlement was in the best interest of our employees, customers, suppliers and shareholders."

"We did not manipulate drug prices and did not violate any laws," Fortner said.

The settlement stems from a 2005 whistleblower lawsuit that was filed under federal and states' false claims statutes. It alleged that McKesson inflated average wholesale prices reported to First Data Bank, which many state Medicaid programs use to set payment rates for pharmaceutical reimbursement.

The federal government settled its portion of the lawsuit in April for more than $187 million.

New York will receive the largest share of the states' settlement, $36 million, according to officials with state Attorney General Eric Schneiderman's office.

"Pharmaceutical distribution companies are not above the law. This settlement holds McKesson accountable for attempting to make millions of dollars in illegal profits," Schneiderman said.

Besides California and New York, states covered in the settlement include Arkansas, Colorado, Delaware, Florida, Georgia, Idaho, Illinois, Indiana, Iowa, Maine, Michigan, Minnesota, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico, North Carolina, North Dakota, Pennsylvania, South Dakota, Tennessee, Texas, Vermont, Washington, West Virginia and Wyoming. The District of Columbia also was covered.
